This Policy is governed by the laws of India. All disputes shall be resolved exclusively through binding arbitration at M/S Balaji & Associates under the Arbitration and Conciliation Act, 1996. The arbitrator's decision is final and binding. Disputes must be brought individually — no class actions.

  1. Limitation of Liability

Rosa Tech's liability arising out of or related to data processing under this Policy shall be limited to the maximum extent permitted under applicable Indian law. We are not liable for any indirect, incidental, or consequential damages arising from your use of our services or any data breach caused by events beyond our reasonable control.

14. Data Subject Rights & Requests
  • 14.1 Rosa Tech honours all rights conferred by applicable Indian law. You may invoke any right below by writing to us at privacy@rosatech.in with sufficient detail for us to verify your identity and locate the relevant data


    • 14.1.1 Right of Access. Receive confirmation whether Rosa Tech processes your Personal Data and, if so, obtain a copy of the data and the key facts of the processing, such as the purpose of processing, categories of Personal Data processed, recipients to whom such Personal Data has been disclosed, criteria and retention period for such Personal Data.


    • 14.1.2 Right to Rectification. Request correction of Personal Data that is inaccurate or incomplete.


    • 14.1.3 Right to Erasure. Ask us to delete Personal Data that is no longer needed for the purposes set out in this Privacy Policy, or that is processed unlawfully. Please note that deletion will not apply where retention is required for legal obligations, dispute resolution, fraud prevention, or the establishment, exercise, or defence of legal claims.


    • 14.1.4 Right to Data Portability. Receive Personal Data that you have provided to us in a structured, commonly used, machine‑readable format and, where feasible, have that data transmitted directly to another controller.

  • 15.2 If any court or competent authority finds that any provision of this privacy policy (or part of any provision) is invalid, illegal, or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted and the validity and enforceability of the other provisions of this privacy policy will not be affected.

17. Breach Notification

At Rosa Tech, we take data breaches seriously. If a breach affecting your Personal Data occurs, we will notify you and the Data Protection Board of India promptly. We will also report to CERT-In within the timeframe required under applicable CERT-In Directions.

18. Definition
  • 18.1 "Affiliates" means any entity that directly or indirectly controls, is controlled by, or is under common control with Rosa Technology Private Limited, where "control" means ownership of more than 50% of the voting share capital or the ability to otherwise direct management and policies.


  • 18.2 "Breach" or "Data Breach" means a security incident leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, Personal Data transmitted, stored, or otherwise processed by Rosa Tech or its processors.


  • 18.3 "Consent" means any freely given, specific, informed, unconditional and unambiguous indication of the Data Principal's wishes, through a clear affirmative action, signifying agreement to the processing of their Personal Data for a stated purpose, as required under the Indian Law.


  • 18.4 "Cookies" means small text files placed on your device by websites you visit, used to remember preferences, analyse traffic and improve user experience. Similar technologies include pixels, web beacons and local storage objects.


  • 18.5 "Data Fiduciary" means Rosa Technology Private Limited, being the entity that, alone or jointly with others, determines the purpose and means of processing Personal Data, as defined under the Indian Law.


  • 18.6 "Data Principal" means the natural person to whom the Personal Data relates — i.e., you, the user, visitor, customer, job applicant, or any individual whose information we collect or process.


  • 18.7 "Personal Data" or "Personal Information" means any information that identifies, relates to, describes, or could reasonably be linked to a natural person, directly or indirectly. These terms are used interchangeably in this Policy and carry the same meaning.


  • 18.8 "Platform" means collectively: the website www.rosatech.in and any sub-domain, blog, community forum, or developer portal; our cloud dashboards, APIsand SDKs; hardware we showcase or sell; and any other channel through which Rosa Tech processes Personal Data.


  • 18.9 "Processing" means any operation or set of operations performed on Personal Data, whether or not by automated means — including collection, recording, organisation, structuring, storage, retrieval, use, disclosure, combination, restriction, erasure, or destruction.


  • 18.10 "Sensitive Personal Data" or "SPI" means a subset of Personal Data that warrants heightened protection, including: biometric data used for unique identification, health or medical data, data concerning sexual orientation or sex life, genetic data, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership and government identification numbers. Rosa Tech collects SPI only where legally required or with explicit Consent.


  • 18.11 "Third Party" means any natural or legal person, public authority, agency, or body other than Rosa Tech, its affiliates, its processors and persons acting under the direct authority of Rosa Tech to process Personal Data.
